Legislators push to hide phone records

Imagine your phone records becoming available to any curious lawyer or court officer, without your knowledge.

The scenario is possible in Pennsylvania, and some lawmakers are trying to address it.

The law allows telecommunication companies to respond however they wish to administrative subpoenas, which are documents any lawyer can produce without a judge’s consent. The law does not require notification of the person whose records are subpoenaed.

Rep. Mike Vereb, R-Montgomery, is sponsoring a bill that would require a judge to approve any handover of personal records.

“This loophole allows anyone to access telecommunications records without any hurdles, with a simple administrative subpoena,” said Vereb, a former police officer.

Sen. Jeffrey Piccola, R-Dauphin County, has introduced an identical bill in the Senate.
