Pennsylvania’s high court has upheld the Gaming Control Board’s decision to grant a slot machine license to the owner of Mount Airy Lodge.Although the board found all five applicants eligible for the license, it ultimately determined that Mount Airy should be awarded the license.
The court rejected assertions by Pocono Manor Investors L.P., one of the failed applicants, that the board’s failure to follow its own deadlines and procedures rendered the application process fundamentally unfair.
Observing that “once the eligibility requirements were met by the applicant, the Board had almost complete discretion to approve or deny a license, subject only to this court’s limited review,” the court further rejected Pocono Manor’s assertion that the board capriciously disregarded the evidence in granting the license to Mount Airy.
